This article demonstrates how the Indonesian Constitutional Court interprets the term 'right' when deciding issue-level questions involving constitutional doctrine. In doing so, we employ the Hohfeldian scheme that configures right into four different meanings of claim right, privilege, power, and immunity. By looking at the molecular configuration of rights in the context of freedom of religion, natural resource control, educational policies, and fair trial, this we contend that the right under the constitution is interpreted by the Court in a dynamic-yet-configured fashion. In this sense, 'dynamic' implies that the Court's interpretation does not adhere to a fixed or consistent vocabulary, while 'configured' suggests that the vocabulary of right is fundamentally configured by both (1) non-relational liberty and (2) power that provides intervention, limitations, or even change over the nature of liberty into liability (i.e., duty to refrain from acting in a certain way). It is manifest that right is hardly expounded by the Court when the term is juxtaposed with any relevant governmental duties and powers. This demonstrates a judicial fabrication of a flexible legal concept used by the judicial authority to justify certain normative objectives.
The Democratic Party dispute raises the view that there is dualism within the Democratic Party. The issue of the Democratic Party Leadership Takeover Movement (GPKPD) led to the dismissal of several of its cadres. The dispute escalated with the holding of the Extraordinary Congress (KLB) in Deli Serdang on March 5, 2021. One of the things which triggered the holding of the KLB by the opposition was the management of Agus Harimurti Yudhoyono (AHY). Apart from being seen as not agreeing with Article 83 paragraph (2) letter b in the 2020 Democratic Party's Articles of Association and Bylaws, the validity of the AHY management along with the preparation of the Articles of Association and Bylaws in 2020 was also questioned by several cadres. In addition, the political dynasty by the Cikeas family was also highlighted. This Democrat Party dispute becomes more interesting to study because the AHY opposition's KLB involves an external party who is a state official. This article is socio-legal study that was carried out textually and critically to laws and regulations and policies. The undemocratic management and election of the general chairman in providing opportunities for other cadres to compete in a transparent and fair manner created internal turmoil that led to the dismissal of several cadres. There are anomalies within the Democratic Party with the increasingly clear Democratic Party as a dynastic party, undemocratic KLB arrangements, to the implementation of KLB which is a structural conflict of the Democratic Party with non-structural collectives.
Film dokumenter "Sejauh Kumelangkah" yang ditayangkan pada Program Belajar dari Rumah Kemendikbud RI di TVRI mendapatkan somasi dari Sutradara Film tersebut atas penayangan, modifikasi dan mutilasi tanpa sepengetahuan dan izin dari pencipta atau pemegang hak cipta film. Rumusan masalah penulisan ini yaitu apa saja bentuk-bentuk pelanggaran hak cipta yang dilakukan oleh Kemendikbud, dan bagaimana langkah-langkah hukum yang dapat dilakukan apabila terjadi pelanggaran hak cipta oleh lembaga pemerintah. Penelitian ini merupakan penelitian hukum yuridis-normatif, dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus yang dilakukan dengan menelaah peraturan perundang-undangan dan regulasi yang bersangkut paut dengan isu hukum. Berdasarkan hasil penelitian, penayangan film Sejauh Kumelangkah tanpa sepengetahuan, izin maupun lisensi dari pemegang hak cipta film tersebut, selain itu juga melanggar hak moral dan hak ekonomi hingga merugikan kehormatan dirinya. Langkah preventif adalah dengan memahami semua aturan yang berkaitan dengan hak cipta, atau sekurang-kurangnya mendapatkan izin lisensi secara tertulis yang telah didaftarkan di DJKI. Langkah-langkah hukum bila terjadi pelanggaran hak cipta, dengan membuat aduan baik perdata maupun pidana kepada DJKI dan/atau Kepolisian agar difasilitasi mediasi, atau melalui penyelesaian sengketa secara Arbitrase atau dengan mengajukan gugatan ganti rugi ke Pengadilan Niaga.
