The current political and legal configuration of the village head election organizing institution is not yet in accordance with election governance with integrity. This happens because the institutional structure is not well ordered. This research examines the problem of legal regulation of the structure of the village head election institution, and looks for the ideal framework for the organization to organize the village head election in the future. The research method used is normative and doctrinal legal research method which is carried out by analyzing positive legal norms. Data collection techniques are carried out by reviewing applicable laws and regulations, books and other literature. The results showed that the legal arrangements for village head election organizers through related regulations led to many institutional structures for village head elections so that the funding for village head elections would be expensive. The idea of an ideal framework for an organizing institution for village head elections in the future can be done by shifting the model of the village head election organizing institution from a government model to an independent model. The application of this model can be done through a legislative or executive review of regulations related to village head elections, and at least including the KPU as the organizing agency for village head elections.
Indonesia's presidential system requires the separation of powers (executive, legislative and judiciary) as it is based on checks and balances. It is stated in the Indonesian Constitution, but it still needs further reform, particularly on the limitation of such tripartite powers. This article uses legal research to analyse and discuss theoretical and practical issues on the governmental system of Indonesia. Theoretically, the authority of state institutions in Indonesia encourages an executive-centered government system. In fact, in carrying out functions and authorities, state institutions do not reflect that the Indonesian system of government embraces the separation of powers. In addition, this study recommends the need for refinement and improvement efforts, to enforce ideal concept and practice.
Indonesia saat ini menganut sistem pemerintahan Presidensil, dimana adanya pemisahan kekuasaan yaitu Eksekutif, Legislatif dan Yudikatif yang berdasarkan prinsip "checks and balances", ketentuan ini tertuang dalam konstitusi, namun tetap diperlukan langkah penyempurnaan, terutama pengaturan atas pembatasan kekuasaan dan wewenang yang jelas antara ketiga lembaga Negara tersebut. Penelitian ini merupakan penelitian hukum normatif, yang menggunakan pendekatan yuridis normatif. Dalam penelitian ini, penulis ingin mengetahui dan membahas berbagai teori dan praktek berdasarkan UUD 1945 atas pelaksanaan sistem pemerintahan Indonesia. Hasil penelitian menunjukkan bahwa secara teoritis kewenangan lembaga-lembaga negara di Indonesia mengarah pada sistem pemerintahan presidensil, namun kemudian secara praktek dalam menjalankan fungsi dan kewenangan, lembaga negara tidak mencerminkan bahwa sistem pemerintahan Indonesia menganut pemisahan kekuasaan yang ada dalam sistem pemerintahan presidensil akan tetapi lebih dekat pada sistem pembagian kekuasaan. Dengan demikian, ketentuan yang diterapkan berdasarkan UUD 1945 diperlukan kembali upaya penyempurnaan, agar secara konsepsional dan prakteknya dapat berjalan secara ideal.
